Terms of Use

This document (the "Agreement") provides the terms and conditions that govern your use of the services offered by or through Callthentic (the "App"). Your use of our services will constitute acceptance of this Agreement.
Services Provided
Callthentic provides you the ability to screen out nuisance calls (robocalls, telemarketers, etc.), and receive detailed information about callers. Information on the calls screened are reported to you via notifications as well as a dashboard in the App. Callthentic intends to only screen calls that are unwanted nuisance calls, but it makes no guarantees regarding the accuracy of the results it provides. We also provide voicemail for authenticated unanswered calls, with automatic transcription when available. Any voicemail received from a mobile number can be replied to directly via SMS, without the need for a voice callback.
Acceptable Conduct
You agree to use the Callthentic services only for purposes that are lawful. You shall not use this service to transmit any unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, sexually explicit, profane, hateful, racially, ethnically, or otherwise objectionable material of any kind, including but not limited to any material that encourages conduct that would constitute a criminal offense, gives rise to civil liability, or otherwise violates any applicable local, state, national, or foreign law.
Operation
Callthentic's service helps you screen and avoid nuisance calls. In order to use several of Callthentic features, the service will help you through a process to setup your phone's unconditional call forwarding feature, which operates by forwarding all inbound calls to a different number. To use Callthentic services, you must configure your phone's unconditional call forwarding service to redirect all calls to our number. Callthentic will then query its own and third parties' databases to identify the caller and provide you with any information available about the caller. You are solely responsible for any charges imposed by your mobile service provider for (i) using the unconditional call forwarding feature, (ii) local or long-distance usage, and (iii) text message and data usage.
Callthentic also requires access to your phone's contacts list, so that whenever your phone forwards a call we can check the number against your list to confirm instantly whether the caller should be presented or screened. We do not upload your contact information to our servers.
Callthentic requires constant access to data in order to handle/receive/answer phone calls. This can be either through Wifi or Cellular data. Today, data services have become almost ubiquitous. If the user is located in an area with poor data service calls may not be presented and would be sent to voicemail. For that reason, we provide a simple method to disable unconditional call forwarding. This disables Callthentic call screening functionality but allows you to accept all calls until the data services become more reliable.
Access Your Contacts
Callthentic does not upload your contacts information to or store it in any database. However, in order to provide its services, Callthentic must access your mobile phone's address book. You must give Callthentic permission to do so. Without that permission, Callthentic cannot function as intended.
Allowing Notifications
Callthentic also requires access to your phone's notifications settings during the setup and activation process. The service uses this access to modify your phone's settings, so the App can notify you (either by text message or by on-screen notification) when it screens a phone call and to inform you when a voicemail is available.
Devices
Callthentic is intended for use on iPhone only. This app is designed to be installed on a single device associated with the owner’s phone number. A phone number can only be registered to a single device at a time.
It can be installed on an iPad, however that device will not be supported for call functionality. An iPad can be utilized to view previous call data and voicemails.
Callthentic recognizes the owner of the mobile phone number on the account as the sole owner of the account. This app is designed to be installed on a single device associated with the owner’s phone number.
Trial Period
Callthentic currently provides a free trial period during which you can use all features of the service for a specified period of time. You can manage or cancel the trial subscription through your App Store account. Once the trial period ends, your monthly billing will begin unless previously cancelled.
Payment
Callthentic’s services are provided through the App Store on a paid subscription basis. Callthentic's rates for services are listed in the App and on the App Store. Callthentic reserves the right to modify its rates at any time. Callthentic does not issue refunds for services. Callthentic does not send invoices to its customers. Should you have a billing dispute, you must contact the App Store.
Changes to Terms of Service
We may from time to time introduce new features to the service or modify or delete existing features. Any new or modified terms will become effective for your use of the service upon the earlier of (i) your use of a new or modified feature to which the new or modified term relates or (ii) the date of your next App Store bill payment.
Cancellation
You may cancel service at any time by contacting the App Store. If you cancel the service, you must deactivate unconditional call forwarding on the App's Settings screen.
Account Suspension or Termination
Callthentic reserves the right, if it reasonably suspects that you are committing fraud or otherwise violating these terms of service, (a) to terminate this Agreement and your access to its services upon one (1) day's electronic notice, (b) to refuse to allow you to recharge your account, or (c) to suspend your account immediately until further investigation takes place.
Limitation of Liability
Callthentic shall not be liable for damages of any type, including but not limited to damages allegedly arising from mistakes, omissions, interruptions, delays, defects, and/or errors in blocking, transmitting, receiving, originating, terminating and/or delivering telephone calls or from the accuracy or inaccuracy of any information provided by Callthentic regarding any caller.
No Warranty
Callthentic does not make any warranties of any kind pursuant to this agreement.
Indemnity
You agree to indemnify, defend, and hold Callthentic, its officers, directors, employees, suppliers, and any third party information providers to the App, harmless from and against all claims, actions, proceedings, expenses, damages and liabilities, including attorney's fees, which are the result of, or are in any way related to, your use of the App or Callthentic's services.
Association. The arbitration shall take place in the State of Georgia. The award rendered by the arbitrator may be entered as a judgment in any court of competent jurisdiction. The cost of the arbitration and the attorney's fees of the prevailing party shall be assessed against the party against whom the award is rendered.
Consent
By entering into this agreement, you consent to the receipt of text messages, and customer service phone communication (including on-screen notifications) from Callthentic regarding (a) the operation of the service and your account and (b) other services and products we believe may be of interest to you.
Trademarks
All corporate names, service marks, logos, trade names, trademarks, websites and domain names of Callthentic, including but not limited to "Callthentic," are and shall remain the exclusive property of Callthentic, and nothing in this agreement shall grant you the license to use such without the express written permission of Callthentic.
Governing Law
This agreement, and all modifications and amendments, shall be governed by the law of the State of Georgia, USA, without giving effect to its conflicts of laws principles.
